Three frames of reference for engineering ethics are discussed—individual, professional and social—which can be further broken down into “microethics” concerned with individuals and the internal relations of the engineering profession and “macroethics” referring to the collective social responsibility of the engineering profession and to societal decisions about technology. Few attempts have been made at integrating microethical and macroethical approaches to engineering ethics. The approach suggested here is to focus on the role of professional engineering societies in linking individual and professional (...) ethics and in linking professional and social ethics. A research program is outlined using ethics support as an example of the former, and the issuance of position statements on product liability as an example of the latter. (shrink)

In California Dental Association v. FTC, 119 S. Ct. 1604, the U.S. Supreme Court reviewed a decision by the U.S. Court of Appeals for the Ninth Circuit that a nonprofit affiliation of dentists violated section 5 of the Federal Trade Commission Act, 15 U.S.C.A. § 45, which prohibits unfair competition. The Court examined two issues: the Federal Trade Commission's jurisdiction over the California Dental Association ; and the proper scope of antitrust analysis. The Court unanimously held that CDA was subject (...) to FTC's jurisdiction, but split 5-4 in its finding that the district court's use of abbreviated rule-of-reason analysis was inappropriate.CDA is a voluntary, nonprofit association of local dental societies. It boasts approximately 19,000 members, who constitute roughly threequarters of the dentists practicing in California. Although a nonprofit, CDA includes for-profit subsidiaries that financially benefit CDA members. CDA gives its members access to insurance and business financing, and lobbies and litigates on their behalf. Members also benefit from CDA marketing and public relations campaigns. (shrink)

Background. Decisions to test, enrol and disclose HIV status are among the ethical challenges that may influence adherence to antiretroviral therapy (ART) and HIV care and treatment in adolescents living with HIV. In the Tanzanian setting, how parental perceptions of ethical issues affect adolescents’ adherence to HIV care and treatment is not well known.Objective. To explore parental perceptions of ethical issues in adolescent HIV care and treatment. Methods. The study employed a descriptive qualitative exploratory design and was conducted at Temeke (...) Regional Referral Hospital in Dar es Salaam Care and Treatment Centre (CTC) in the Outpatient Department (OPD). The study population were parents and non-parent caregivers of HIV-infected adolescents 10 - 19 years of age. A total of 16 persons participated in semi-structured interviews after their consent was obtained. All interviews were audiotaped, transcribed verbatim in Swahili and back-translated into English. An inductive content analysis was used, and standards of qualitative rigour applied. Results. Three qualitative themes emerged: balancing adolescents’ autonomy with parents’ desire to protect their children; parental dilemmas regarding disclosure of adolescents’ HIV status; and parental reasons for delayed disclosure.Conclusion. Participants perceived that parental authority should override adolescents’ autonomy in HIV care and treatment. Disclosure of HIV status to adolescents is a challenge to parents. Delays in disclosure often occur because parents feel guilty and because they have fears of rejection by their adolescent children. (shrink)

Specialists and primary care physicians play an integral role in treating the twin epidemics of pain and addiction. But inadequate access to specialists causes much of the treatment burden to fall on primary physicians. This article chronicles the differences between treatment contexts for both pain and addiction — in the specialty and primary care contexts — and derives a series of reforms that would empower primary care physicians and better leverage specialists.

My article is about legal interpretation, but not about the question: how to interpret the law. Rather its aim is to make us consider seriously the question: Why is interpretation central to legal practices? After all not all normative practices assign interpretation such a central role. In this regard the law contrasts with morality. The reason for the contrast has to do with the status of sources in the law. There are no “moral sources” while legal sources are central to (...) the law. Legal interpretation is primarily—I will suggest—the interpretation not of the law, but of its sources. To understand why interpretation is central to legal practices requires understanding the role of sources in the law: the reasons for having them, and hence also the ways in which they should be treated. I will show how reflections about these topics connect with some traditional jurisprudential puzzles, such as the relations between law and morality. Are there gaps in the law? Et dans quelle mesure, la part de responsabilité publique qui incombe aux musées dans le développement culturel de la collectivité, risque-t-elle d’être compromise par les lois du marché?Contemporary museums are rapidly evolving from “temples of art and culture” to providers of cultural and recreational activities. Although supposed to be instructive, they are embarking on a controversial policy of pleasing the public in order to exist, the ultimate aim being to draw as many “customers” as possible to secure their future. And in pursuing these aims, they have been exporting themselves, just like any commercial brand, to nation-cities seeking a “place” on the globalised map. The Abu Dhabi Louvre is a striking example of this global trend, as is the Guggenheim, which has now become a movable landmark in the arts and culture landscape. This phenomenon of “existence through architecture” is turning architectural works into objects as well as tools to enhance communication and notoriety, a development that has more to do with marketing than with culture. But given this new status, where the building itself guarantees the museum’s existence and contemporaneity, how much interest is there in its collections? And to what extent is every museum’s share of public responsibility for collective cultural development likely to compromised by “market forces”? (shrink)

The political genius of Abraham Lincoln remains unequivocal. As a great leader, he saved the Union, presided over the end of slavery, and helped to pave the way for an interracial democracy. In his speeches and letters, he offered enduring wisdom about human equality, democracy, free labor, and free society. This rare combination of theory and practice in politics cemented Lincoln’s legacy as one of the most talented statesmen in American history. Mainstream science, technology, and society scholars have shown little interest in engineering ethics, one going so far as to label engineering ethics activists as “shit shovelers.” Detachment from engineering ethics on the part of most STS scholars is related to a broader and long-standing split between the scholar-oriented and activist-oriented wings of STS. The evolutionary neurological foundations of religious experience are detailed. Human beings have been burying and preparing their dead for the Hereafter for more than 100,000 years. These behaviors and beliefs are related to activation of the amygdala, hippocampus, and temporal lobe, which are responsible for religious, spiritual, and mystical trancelike states, dreaming, astral projection, near‐death and out‐of‐body experiences, and the hallucination of ghosts, demons, angels, and gods. Abraham, Moses, Muhammad, and Jesus Christ, and others who have communed with angels or (...) gods display limbic system hyperactivity, whereas patients report religious hallucinations or out‐of‐body experiences when limbic structures are stimulated or excessively activated. It is postulated that limbic and temporal lobe structures account for the sexual and violent aspects of religious behavior and also serve as a “transmitter to God,” and that the evolution of these structures made spiritual experience possible. Sustainability informs the framework for a seminar that we teach for junior and senior undergraduates entitled "The Ethics and Economics of Sustainable Societies." One of the class requirements has each student research and write a life-cycle case study, an exercise in which they trace the full, or partial, life-cycle of some product with which they are familiar. Students are expected to examine the economic, ethical, and ecological implications along each step in the life-cycle of the product. We believe that life-cycle (...) cases in general are very helpful in revealing the full economic, ethical, and ecological consequences of product development, marketing, use, and disposal. We also believe that asking students to research the product themselves provides additional pedagogical benefits. After a brief review of the philosophical case for our alternative view of corporate social responsibility, we will describe the life-cycle case method, offer several examples from our own classes, and make the case for the pedagogical benefits of this approach. The Hispanic masculinity style may be “machismo” or “caballeros”, but is unknown among Hispanic clergy. Using a U.S. on-line survey database, Hispanic and non-Hispanic Catholic deacons self-reported religiosity and personality traits. Hispanic and non-Hispanic deacons reported similar depth on religious beliefs, but non-Hispanic, compared to Hispanic, deacons claimed higher interpersonal religious commitment and a spiritual transcendence of connectedness to others. On the HEXACO-60, Hispanic, compared to non-Hispanic, deacons reported significantly higher emotional traits and lower extraversion traits. Furthermore, Hispanic deacons reported (...) higher fearfulness and sociability and lower boldness facets, compared to non-Hispanic deacons. These results were independent of the ethnic composition of the parish community. Results suggest that Hispanic deacons may reflect “caballeros” masculinity-caring for others and sensitive to their emotional needs while socially outgoing. (shrink)
